1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and DockDocForms LLC, a limited liability company organized under the laws of the State of Wyoming ("DockDocForms," "we," "us," or "our"), governing your access to and use of the website located at dockdocforms.com, together with any related applications, features, and content (collectively, the "Service").

By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of a company, vessel operator, or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.

2. Description of the Service

DockDocForms provides a reference tool for port operations, including port entry procedures, required forms, port call information, local intelligence and tips, spares and repairs contacts, and — on applicable plans — live AIS vessel tracking and port call scheduling.

DockDocForms does not submit, file, or transmit any form on your behalf to any port authority, customs agency, or other government or private body. The Service tells you what is required and where to obtain it; the act of filing, submitting, or complying with any requirement remains solely your responsibility or that of your agent.

3. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of any credentials or sign-in link associated with your account and for all activity that occurs under it. Notify us promptly at dockdocforms@gmail.com if you suspect unauthorized use of your account.

Basic access to the Service does not require an account. Creating an account allows your saved ports, vessels, and preferences to persist across devices, and is required to subscribe to a paid plan.

4. Subscriptions, Billing & Payment

Paid plans (currently Officer, Master, Fleet, and Carrier) are billed on a recurring basis — monthly or annually, as selected at checkout — until cancelled. Payment is processed by our third-party payment processor, Stripe, Inc. ("Stripe"). We do not store your full payment card details; by subscribing, you also agree to Stripe's terms of service, available at stripe.com/legal.

Unless you cancel before the end of the current billing period, your subscription will automatically renew at the then-current price for that plan, and your payment method on file will be charged automatically. We will make reasonable efforts to notify you by email in advance of any price increase to your active plan.

Plan scope limits (number of ports, vessels, or seats) are as described on our Pricing page at the time of purchase and are subject to change on a going-forward basis for future billing periods.

5. Free Plan

The Free plan is provided at no cost and may be limited in scope, features, or the number of ports available, as described on our Pricing page. We may modify, limit, or discontinue the Free plan at any time without liability to you, though we will make reasonable efforts to provide notice of material reductions in scope.

6. Cancellation & Refunds

You may cancel a monthly subscription at any time through your account's billing portal; cancellation takes effect at the end of the current billing period, and no partial-month refund is issued for the remaining days. Annual subscriptions cancelled within the first 30 days of the initial purchase are eligible for a prorated refund at our discretion; annual subscriptions cancelled after 30 days remain active through the end of the paid term but are not refunded for the unused portion.

We reserve the right to change this refund policy for future purchases by updating this page; changes will not apply retroactively to a subscription already in effect.

7. Data Accuracy Disclaimer

This section is central to your use of the Service and you should read it carefully.

The port information, form requirements, procedures, schedules, contact details, fees, and related content made available through the Service (collectively, "Port Data") are compiled from publicly available sources, including but not limited to government and port authority websites, published notices, industry publications, and third-party reporting. DockDocForms does not independently verify Port Data with the relevant port authority, customs agency, or other issuing body before publishing or updating it, and does not control how frequently those original sources change their own requirements.

Port Data is provided "as is" and is assumed to be accurate at the time it was compiled, but requirements, forms, fees, contacts, and procedures at any port can and do change without notice from the issuing authority, and errors can occur in sourcing, transcription, or translation. Accordingly:

If you believe any Port Data is inaccurate or out of date, please report it to dockdocforms@gmail.com so we can review and, where appropriate, correct it — but a report or correction does not retroactively create liability for prior reliance on that data.

8. No Professional or Regulatory Advice

The Service is a reference and preparation tool. It is not legal, customs, regulatory, maritime, or professional advice, and is not a substitute for consulting a licensed ship's agent, customs broker, attorney, or the relevant port or flag-state authority. Decisions about vessel compliance, documentation, and port entry remain the responsibility of the vessel's master, operator, and agent.

9. Acceptable Use

You agree not to: (a) scrape, copy, or redistribute Port Data or other Service content in bulk for a competing product or service; (b) circumvent any access, authentication, or plan-tier limitation; (c) use the Service to violate any applicable law or the rights of any third party; or (d) interfere with or disrupt the integrity or performance of the Service.

10. User-Uploaded Data & Files

The Service may allow you to upload files associated with a vessel or port call — including but not limited to BAPLIE files, stowage plans, manifests, or other vessel or cargo data (collectively, "Uploaded Data"). You upload Uploaded Data entirely at your own risk.

If you believe Uploaded Data has been accessed by someone your Vessel Admin did not authorize, contact dockdocforms@gmail.com immediately.

11. Third-Party Content & Services

The Service may display or link to third-party content, including AIS vessel tracking data, port agent and chandler listings, spares and repairs contacts, and links to external sites. DockDocForms does not control and is not responsible for the accuracy, availability, or conduct of any third party, including any agent, chandler, or supplier listed on the Service, whether or not that listing is a paid placement. Any transaction or communication you have with a third party listed on the Service is solely between you and that party.

12. Intellectual Property

The Service, including its compilation, organization, design, and original written content, is owned by DockDocForms and protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal port-operations purposes. You may not reproduce, resell, or create derivative works from the Service without our prior written consent.

13. Disclaimer of Warranties

Except as expressly stated in these Terms, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any AIS tracking, scheduling, or other live data will be accurate or available at all times.

14. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will DockDocForms, its members, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of, or inability to use, the Service — including damages arising from Port Data described in Section 7 or from any Uploaded Data described in Section 10 — even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Dock Doc LLC's total aggregate liability to you for any claim arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid to Dock Doc LLC in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Dock Doc LLC and its members, officers, employees, and contractors from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your reliance on Port Data in a manner inconsistent with Section 7; or (d) any file or data you upload in a manner inconsistent with Section 10.

16. Termination

You may stop using the Service or cancel your subscription at any time as described in Section 6. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, or if we discontinue the Service in whole or in part. Sections 7, 10, and 12–19 survive any termination of these Terms.

17. Changes to the Service or These Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide notice by posting the updated Terms on this page and updating the "Last updated" date above, and, where required by law or where the change materially affects a paid subscriber's rights, by email. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

18. Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

If you would prefer an arbitration clause here instead of court litigation, that is a deliberate legal strategy choice (it affects class-action exposure, cost, and appeal rights) best made with your attorney rather than defaulted here.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dock Doc LLC regarding the Service.
